Commonwealth of Kentucky Vs. Michael B. Bickett and McFall Indictment

The Grand Jury charges: Count One: That on or about December 23, 2022 in Hancock County, Michael B. Bickett (27), of Hawesville, committed the offense of Wanton Endangerment in the First Degree when he wantonly engaged in conduct which created a substantial danger of death or serious physical injury to Jacoby Gray (22). Count Two: That on or about December 23, 2022 in Hancock County, Bickett committed the offense of Operating a Motor Vehicle Under the Influence of controlled substance (agg circum.), Second Offense, when he was operating a motor vehicle while under the influence of alcohol/and or controlled substance.

On February 3, 2023 Bickett’s bond was set at $25,000 cash and an Arraignment is scheduled for Friday, February 24th at 10:00 a.m. The non-financial conditions of Bickett’s bond are: no use of alcohol or drugs; no new arrests or violation of law; no use/possess firearm or other weapon; no possession of police scanners; home incarceration except for employment, court appearances, meeting with attorney, or medical emergencies; M.C.R. release – must see pretrial before released from jail; must pay $25 bond fee and $40 Sheriff’s services fee before release; must sign waiver of search and seizure; must pay all jail fees before release; no contact with victim or their family; pay current child support; maintain employment; and must submit to weekly drug tests at defendant’s costs if requested.

As reported by the arresting officer, Deputy B.J. Burton, on Friday, December 23rd, 2022 at approximately 12:20 a.m., a vehicle accident was reported by the mother of Michael Bickett. She had called the Hancock County Sheriff’s Office and stated that Bickett had wrecked his vehicle and was in need of help because in an interview he stated he was under the influence of multiple drugs – that night, marijuana and alcohol. His passenger, Jacoby Gray, was reported missing from the wreck. Bickett stated that Gray exited the vehicle and did not know where they were.

Bickett drove the vehicle home and while arriving at home, Gray was not heard from. That evening, the parents of Jacoby Gray filed a missing persons report. Upon arriving at Bickett’s residence, Deputy Burton located the vehicle he was driving with severe damage and lots of blood in the passenger seat where Gray had been seated.

Bickett stated he did not know where Gray went and failed to call because he said he was under the influence of drugs and alcohol, and had illegal drugs in the vehicle. Bickett was interviewed, Miranda rights were read and he was arrested on the charges. He was transported to the Breckinridge County Detention Center.

Bickett is a convicted felon and had been release from prison in early 2022. This is an ongoing investigation, as the wreck and Jacoby’s death both occurred in Indiana. The prosecutor in Perry County is Samantha Hurst. ISP Jasper Post’s Detective Fisher was assigned to the investigation.

Commonwealth Vs. Jacob A. McFall Indictment

   The Grand Jury charges: Count One: That on or about January 17, 2023 in Hancock County, Jacob A. McFall (21), of Hawesville, committed the offense of Wanton Endangerment in the First Degree when he wantonly engaged in conduct which created a substantial danger of death or serious physical injury to Terry Morris. Count Two: That on or about January 17, 2023 in Hancock County, Jacob A. McFall committed the offense of Wanton Endangerment in the First Degree when he wantonly engaged in conduct which created a substantial danger of death or serious physical injury to Tim Boarman.

Count Three: That on or about January 17, 2023 in Hancock County, Jacob A. McFall committed the offense of Wanton Endangerment in the First Degree when he wantonly engaged in conduct which created a substantial danger of death or serious physical injury to a minor child. Count Four: That on or about January 17, 2023 in Hancock County, Jacob A. McFall committed the offense of Wanton Endangerment in the First Degree when he wantonly engaged in conduct which created a substantial danger of death or serious physical injury to a minor child.

Deputy Butch Garst, Lead School Resource Officer for Hancock County Schools and SRO at HCHS/HCMS campus, appeared before the Grand Jury as a witness. The Arraignment is scheduled for Friday, February 24th at 10:00 a.m. The bond was set at $10,000 cash. The non-financial conditions of McFall’s bond are: no use of alcohol or drugs; no new arrests or violation of law; no use/possess firearm or other weapon; no possession of police scanners; home incarceration except for employment, court appearances, meeting with attorney, or medical emergencies; M.C.R. release-must see pretrial before released from jail; must pay $25 bond fee and $40 Sheriff’s services fee before release; must sign waiver of search and seizure; must pay all jail fees before release; no contact with victims or their families; pay current child support; maintain employment; and must submit to weekly drug tests at defendant’s costs if requested.

Deputy Butch Garst reported on Friday, January 17th, 2023 that Terry Morris and Tim Boarman had arrived at 6249 State Route, 144 East, McFall residence, and picked up Charles McFall on behalf of Hancock County Schools in a marked Hancock County School van. While there and trying to leave, Jacob McFall came out shooting and waving a pistol near them. They said it was a small caliber revolver. Morris has known Jacob for many years and tried to calm him and explain what was going on in order to leave safely. Jacob advised he shot 3 times into the ground as a warning. Shooting and waving the firearm near the 2 adults and 2 juveniles in the van in the drive showed an extreme indifference to the value of human life and engaged wantonly in conduct which created a risk of danger of death or serious physical injury to another person; being 2 occupants of the van.

Commonwealth of Kentucky Vs. James C. Decker, Jr. Indictment

The Grand Jury charges that on or about December 9, 2022 in Hancock County, James C. Decker, Jr. (64) of Hawesville, committed the offense of Possession of a Controlled Substance in the First Degree when he knowingly and unlawfully possessed a quantity of methamphetamine. Bond was set at $5,000 cash. The Arraignment is scheduled for Friday, February 24th, 2023 at 10:00 a.m. Deputy B.J. Burton, with the Hancock County Sheriff’s Office, appeared before the Grand Jury as a witness for the Commonwealth.

Arresting officer, Deputy B.J. Burton reported that on Friday, December 9th, 2022 at 11:05 p.m., Decker was a passenger in a traffic stop on 69 South in Hawesville and was asked to exit the vehicle due to no insurance and the driver being a DUI suspect. Upon talking to Decker and performing a search of his person, a small container with around 1.5 grams of methamphetamine was found in his right side jacket pocket. Decker admitted that it was his in front of Deputy Burton and the Cloverport officer (Chris Woosley). Decker was read Miranda rights and transported to the Breckinridge County Detention Center.

Commonwealth of Kentucky Vs. Randall A. Weatherholt Indictment

The Grand Jury charges: Count One: That on or about December 6, 2022 in Hancock County, Kentucky, Randall Allen Weatherholt (46), of Hawesville, committed the offense of Manufacturing Methamphetamine, Second Offense, when he knowingly and unlawfully manufactured methamphetamine or, with the intent to manufacture methamphetamine, had in his possession the chemicals or equipment used for the manufacture of methamphetamine. Count Two: That on or about December 6, 2022 in Hancock County, Randall A. Weatherholt committed the offense of Unlawful Possession of a Methamphetamine Precursor when he knowingly and unlawfully possessed a drug product or combination of drug products containing ephedrine, pseudoephedrine, or phenylpropanolamine, or their salts, isomers, or salts of isomers with the intent to use as a precursor to manufacturing methamphetamine. Count Three: That on or about December 6, 2022 in Hancock County, Randall A. Weatherholt committed the offense of Assault in the Fourth Degree when he intentionally or wantonly caused physical injury to Samantha Sexton.

Bond is set at $25,000 cash. The arraignment is scheduled for February 24th, 2023 at 10:00 a.m.

Deputy Jeff Hendrick reported that a call was made to Weber store on Tuesday, December 6th, 2022 in reference to a female being assaulted at the address of 3267 State Route 144 East. Hendrick arrived at Weber store, met with the caller (Samantha Sexton) and she advised that her boyfriend as well as her boyfriend’s mother had assaulted her. Samantha had a cut above her left eye and was covered in blood on her arms, hands, shirt, head and face. She advised that she was bitten by the subject’s aunt’s dog on her left leg. She had blood soaking through blue jean pants. Deputy Hendrick left the scene after speaking to her as well as contacting emergency medical services to examine her injuries. Deputy Hendrick arrived at 3267 State Route 144 East and spoke to Randall Weatherholt in reference to the assault. Upon further investigation, Hendrick found/observed items that were active, that was/have been used in and production of Methamphetamine, as well as Precursors used to Manufacture Methamphetamine.

Weatherholt was Mirandized. He stated he had a problem and had been manufacturing methamphetamine as well as advising what items were in bags that were found by Deputy Hendrick. Weatherholt advised that other parts of the Meth Lab were not on the premises and that he would drive down the road after cutting them up and throw them out because it was dangerous to keep them on the property where his family also lived.

Deputy Hendrick advised Deputy Aaron Emmick with the Hancock County Sheriff’s Office for scene clean up as well as decontamination of the scene and packaging and transporting of hazardous items. The time of Weatherholt’s arrest was 7:12 p.m. on December 6, 2022.

Commonwealth of Kentucky vs. Brendi S. Cruse Defendant Indictment

The Grand Jury charges: Count One: That on or about July 15, 2022 in Hancock County, Kentucky, Brendi S. Cruse (26), of Owensboro, committed the offense of Fleeing Police in the First Degree, when she, while operating a motor vehicle with the intent to flee or elude, knowingly or wantonly disobeyed a direction to stop given by Deputy Aaron Emmick, thereby creating a risk of death or serious physical injury to another person or persons. Count Two: That on or about July 15, 2022 in Hancock County, Kentucky, Brendi S. Cruse committed the offense of All Terrain Vehicle Violation when she operated an ATV/UTV on a roadway.

Cash bond was set at $10,000. The arraignment is scheduled for February, 24th at 10:00 a.m. The defendant: may not use alcohol or drugs, have no new arrests or violation of the law, have no use/possess a firearm or other weapon and no possession of police scanners; must abide by Home incarceration except for employment, court appearances, meeting with an attorney or medical emergencies; must pay $25 bond fee and $40 Sheriff’s services fee before release; must sign waiver of search and seizure; and must pay all jail fees before release. The defendant may have no contact with the victim or their family, must pay current child support, must maintain employment and must submit to weekly drug tests at the rate of $25 per month.

The Affiant, Deputy Aaron Emmick (Hancock County Sheriff Dept.), stated that on Friday, July 15th, in Hancock County, the defendant, Brendi S. Cruse, unlawfully: in compliance with Eli Claise, committed the offense of Fleeing and Evading Police, 1st degree in violation of KRS 520.095 when the defendants were riding a 4-wheeler on Madison Street in Hawesville. It is a misdemeanor to operate an ATV on public roadway as detailed in KRS 189.515. Deputy Emmick attempted to stop the vehicle by engaging his lights. Brendi Cruse was driving the vehicle and Eli Claise was riding behind her. When the lights were turned on the two defendants took off through Kreisle subdivision at a high rate of speed to avoid the stop. They went through the subdivision and onto Brad Shearn’s field behind Joe Kreisle’s home. The defendants were identified by Deputy Emmick prior to fleeing. A Warrant of Arrest/Complaint Warrant was executed and signed on July 26th, 2022.

Commonwealth of Kentucky Vs. Aaron C. Stanley Indictment

The Grand Jury charges: Count One: That on or between January 29, 2022 through July 22, 2022 in Hancock County, Aaron C. Stanley (30), of Lewisport, committed the offense of Unlawful Access to a Computer in the Second Degree when he knowingly and willfully, without consent, directly or indirectly accessed or attempted to access any computer software, computer program, computer system, computer network or any part thereof, for the purpose of obtaining money, property services from another for himself or another by means of false or fraudulent pretenses, representations or promises.

Count Two: That on or between January 29, 2022 through July 22, 2022 in Hancock County, Aaron C. Stanley committed the offense of fraudulent Use of a Credit/Debit Card when he, with the intent to defraud, knowingly and unlawfully used a debit or credit card of Hancock County Rescue Squad to obtain money, good or services.

Count Three: That on or between January 29, 2022 through July 22, 2022 in Hancock County, Aaron C. Stanley committed the offense of Theft by Unlawful Taking or Disposition Gasoline when he stole $809.27 worth of gasoline.

Deputy Chris DeJarnette, with the Hancock County Sheriff’s Office, appeared before the Grand Jury as a witness for the Commonwealth. Cash bond was set at $10,000. Arraignment is scheduled for February 24th, 2023 at 10:00 a.m. Non-financial conditions of his bond: no use of alcohol or drugs; no new arrests or violation of law; no use/possess firearm or other weapon; no possession of police scanners; home incarceration except for employment, court appearances, meeting with attorney, or medical emergencies; M.C.R. release-must see pretrial before released from jail; must pay $25 bond fee and $40 Sheriff’s services fee before release; must sign waiver of search and seizure; must pay all jail fees before release; no contact with victim or their family; pay current child support; maintain employment; and must submit to weekly drug tests at defendant’s costs if requested.

Stanley was arrested on 8-05-2022 at 10:37 a.m. The arresting officer reported that Stanley Unlawfully Accessed a Computer, 2nd Degree; Fraudulently Used a Credit Card in the amount of $500; and Unlawfully took $500 in gasoline. Stanley obtained a credit/fuel card that was paid by and owned by Hancock County Fiscal Court/Rescue Squad and purchased fuel for his personal vehicle.

Commonwealth Vs. Joshua W. McManaway
